Civil Action No. A-00-CA-457-JRN.
August 26, 2005
ORDER
Before the Court is Parties' Stipulation and Proposal Regarding Extension of Deadlines in Amended Scheduling Order During Mediation. Based on this document, the applicable legal authority, and the entire case file, the Court enters the following Order.
On September 15, 2004, the Court entered an Order granting Parties' Joint Motion to Modify the Scheduling Order. As a result, the Court set September 29, 2004 as the deadline for Defendants' opposition to Plaintiffs' Amended Motion for Class Certification. Moreover, the Court set October 22, 2004 as the deadline for Plaintiffs' reply. The Parties now request that the aforementioned deadlines be extended by an additional 60 days.
Considering that this is the Parties' second such request, the Court finds a 60-day extension as too generous. On the other hand, the Court finds a 30-day extension as plentiful. The Court, however, cautions the Parties that this is the last extension of the deadlines in the Scheduling Order.
IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that Parties' Stipulation and Proposal Regarding Extension of Deadlines in Amended Scheduling Order During Mediation is hereby GRANTED.
IT IS FURTHER ORDERED that: (1) Defendant shall have until October 29, 2004 to file an opposition to Plaintiffs' Amended Motion for Class Certification; (2) Plaintiffs shall have until November 22, 2004 to file a reply; and (3) all other dates in the Scheduling Order shall remain unchanged.
