In the Interest of C.R., a Child
ORDER Trial court case numbers: 2017-01303J; 2017-01304J; 2017-01768J; 2017-01769J Trial court: 313th District Court of Harris County
These are appeals from orders certifying a juvenile to stand trial as an adult. Juvenile certification appeals are to be brought to final disposition within 180 days of the date the notice of appeal is filed. See Order Accelerating Juvenile Certification Appeals and Requiring Juvenile Courts to Give Notice of the Right to An Immediate Appeal, Misc. Docket No. 15-9156 (Tex. 2015), http://www.txcourts.gov/media/1055398/159156.pdf (mandating that courts of appeals ensure, as reasonably possible, that juvenile-certification appeals are brought to final disposition within 180 days of date notice of appeal is filed). The notices of appeal in this case were filed on March 12, 2018, thus the date of final disposition should be no later than September 7, 2018.
In the ordinary course, this court does not set cases for submission during the months of July and August. To set this case for submission and meet the accelerated deadline for disposition, the court issued an order on March 15, 2018 setting a schedule for the filing of the clerk's and reporter's records on March 22, 2018. The briefing schedule was dependent upon the record being filed as ordered.
The court reporter has requested and received one extension and has now filed a second request for extension. We grant this request, but no further extensions will be granted. The schedule for the filing of the reporter's record and the briefs is amended as set out below:
April 11, 2018 | reporter's records due (no further extensions will be granted) |
May 11, 2018 | appellant's brief due |
June 11, 2018 | State's brief due |
June 18, 2018 | reply brief due |
No briefing extensions will be granted absent a showing of extraordinary circumstances and good cause.
The case will be submitted on June 26, 2018 to a panel consisting of Justices Keyes, Bland, and Massengale. There will be no oral argument unless a party requests argument and the court issues a subsequent order scheduling argument. See TEX. R. APP. P. 39.8.
It is so ORDERED. Judge's signature: /s/ Michael Massengale
