Order to show cause issued; returnable in Court of Appeal, Third Appellate District
The Secretary of the Department of Corrections and Rehabilitation is ordered to show cause before the Court of Appeal, Third Appellate District, when the matter is placed on calendar, why petitioner is not entitled to relief based on his claim that his murder conviction must be reversed based on People v. Chiu (2014) 59 Cal.4th 155.
Cantil-Sakauye, C. J., was recused and did not participate.
