MOTION DECISION

CHERYL E. CHAMBERS, J.P., COLLEEN D. DUFFY, ANGELA G. IANNACCI, PAUL WOOTEN, JJ.

Appeal by Sean Sorohan from an order of the Family Court, Nassau County, dated March 25, 2021, which was dismissed by decision and order on motion of this Court dated May 10, 2021, on the ground that no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 4, and leave to appeal has not been granted. Motion by the appellant, inter alia, for leave to appeal to this Court from the order dated March 25, 2021, and to stay certain proceedings in the Family Court, Nassau County, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal to this Court from the order March 25, 2021, is denied; and it is further, ORDERED that the motion is otherwise denied as academic.
