Appeal from J. RUNCO, Judge, 19th District Court; Dearborn, Michigan.


On order of the Court, the complaint for superintending control is considered. Counsel for the Judicial Tenure Commission having represented at oral argument that, consistent with MCR 9.205(E), the Commission must consider all circumstances, including equitable defenses, in deciding whether to take action, and further that the master is authorized to recommend dismissal at any time during the proceedings, the complaint for superintending control is DISMISSED. The stay of proceedings imposed by the order of March 18, 1999 is VACATED. Motions by the Michigan Probate Judges Association and the Association of Black Judges of Michigan for leave to file briefs amici curiae are considered, and they are GRANTED.
