IN RE JONATHAN COLE, Relator

Writ of Mandamus Denied, Opinion Filed January 31, 2012

Original Proceeding from the County Court at Law No. 5

Dallas County, Texas

Trial Court Cause No. CC-11-3364-E

MEMORANDUM OPINION

Before Justices O'Neill, Francis, and Murphy

Opinion by Justice Murphy

Relator contends the trial court erred in compelling arbitration. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has an adequate remedy on appeal. See Tex. R. App. P. 52.8(a); In re Gulf Exploration, LLC, 289 S.W.3d 836, 842-43 (Tex. 2009). Accordingly, we DENY relator's petition for writ of mandamus. We also DENY real party in interest's request for sanctions.

MARY MURPHY

JUSTICE
