MEMORANDUM OPINION

ROBERT D. BURNS, III CHIEF JUSTICE

Before the Court is appellant's December 11, 2024 notice of non-suit which we construe as a motion to dismiss because he no longer desires to pursue this appeal. We grant the motion and dismiss the appeal. See Tex. R. App. P. 42.1(a)(1).

JUDGMENT

In accordance with this Court's opinion of this date, the appeal is DISMISSED.

It is ORDERED that appellee Marisa Zapien recover her costs of this appeal from appellant Jaime Zapien.
