Order

On order of the Court, the application for leave to appeal the April 27, 2023 judgment of the Court of Appeals is considered. We direct the Clerk to schedule oral argument on the application. MCR 7.305(H)(1).

The parties shall file supplemental briefs in accordance with MCR 7.312(E), addressing whether: (1) the Kalamazoo Circuit Court Family Division erred in finding statutory grounds for termination were proven by clear and convincing evidence; (2) the petitioner failed to make reasonable efforts to rectify the condition that led to the child's removal; and (3) the trial court erred by concluding that the conditions leading to adjudication could not be rectified in a reasonable amount of time with continued guardianship while expanding the respondent's parenting time and providing appropriate services.

The Clerk of the Court shall place this case on the October 2023 session calendar for argument. Appellant's brief and appendix must be filed no later than August 15, 2023, and appellee's brief and a separate appendix (if any) must be filed no later than September 8, 2023. Appellant may file a reply brief no later than September 20, 2023.

The Children's Law Section and the Family Law Section of the State Bar of Michigan are invited to file briefs amicus curiae, to be filed no later than September 20, 2023. Other persons or groups interested in the determination of the issues presented in this case may move the Court for permission to file briefs amicus curiae, to be filed no later than September 20, 2023.
