IN THE MATTER OF CJA APPOINTED COUNSEL OBTAINING PARALEGAL, INVESTIGATION AND OTHER SERVICE PROVIDERS WITHOUT PRIOR AUTHORIZATION.


Frances M. Tydingco-Gatewood Chief Judge, District Court of Guam

Pursuant to 18 U.SG. § 3006A(e)(2), CJA appointed counsel are required to obtain prior authorization from the District Court for any service provider fees in excess of $900.00 per case. For efficiency of counsel and the court, the court hereby authorizes CJA counsel to utilize the services of paralegals, investigators, interpreters, and other service providers up to $2,700.00 for each service provider type without further order of the court. CJA counsel and service providers shall otherwise comply with 18 U.S.C. § 3006A(e)(2), and agree to be bound by the presumptive hourly rates established by the Ninth Circuit Judicial Council.

This General Order is consistent with the recommendation of the Judicial Counsel of the Ninth Circuit Court of Appeals contained in the Criminal Justice Act Policies and Procedures, adopted on October 20, 2016.
