ON PETITION FOR WRIT OF MANDAMUS

ORDER

PER CURIAM

Relators the City of San Benito, Texas and Ricardo Guerra have filed a petition for writ of mandamus asserting that the trial court erred by issuing a ruling restraining them "from adopting or confirming any results from the November 5, 2024 election relating to the propositions and/or charter amendments identified in Order Number 2024-0806-001" and voiding the votes relating to those propositions and/or charter amendments. Relators also seek to stay the trial court's ruling pending the results of this original proceeding.

The Court, having examined and fully considered the request for temporary relief, is of the opinion that it should be carried with the case. See TEX. R. APP. P. 52.10 ("Unless vacated or modified, an order granting temporary relief is effective until the case is finally decided."). The Court requests the real party in interest, Julian Rios, or any others whose interest may be affected by the relief sought, to file a response to the petition for writ of mandamus on or before the expiration of five days from the date of this order. See id. R. 52.2, 52.4, 52.8.
