Opinion

B167025.

10-31-2003

In re CHRISTINA S. et al., Persons Coming Under the Juvenile Court Law. LOS ANGELES COUNTY DEPARTMENT OF CHILDREN AND FAMILY SERVICES, Plaintiff and Respondent, v. CHRISTOPHER S., Defendant and Appellant.

John L. Dodd, under appointment by the Court of Appeal, for Defendant and Appellant. No appearance for Plaintiff and Respondent.

Appellant Christopher S. (Father) appeals the order denying his Welfare and Institutions Code section 388 petition entered May 5, 2003, with respect to the minor children, nine-year-old Christina S. and eigh-year-old Christopher S.

We appointed counsel to represent Father on appeal. After examination of the record, counsel notified this court in writing that, pursuant to In re Sade C. (1996) 13 Cal.4th 952, counsel was unable to file an opening brief. On August 15, 2003, the clerk of this court mailed Father a notice, addressed to Fathers last known address, that advised Father to submit within 30 days any contentions or issues he wished this court to consider. Father failed to file any response with this court.

Because Father has failed to raise any claim of error or other defect, the appeal is dismissed as abandoned. (In re Sade C., supra, 13 Cal.4th at p. 994.)

DISPOSITION

The appeal is dismissed.

We concur, KLEIN, P.J. and ALDRICH, J.
