IN RE C.H.L.

From the 81st Judicial District Court, Atascosa County, Texas
Trial Court No. 16-07-0659-CVA
Honorable Melissa Uram-Degerolami, Judge Presiding

ORDER

This is an accelerated appeal from a July 6, 2017 order terminating appellant's parental rights. Appellant timely filed notice of appeal in the trial court on July 19, 2017. Accordingly, the record was due July 29, 2017. See Tex. R. App. P. 26.1(b), 35.1(b). The record was not filed.

The notice of appeal was not filed in this court until August 16, 2017. On August 18, 2017, the clerk of this court notified the court reporter by letter that the record was late. Our letter required the record be filed by August 28, 2017. On August 28, 2017, the court reporter filed a notification of late record stating the anticipated length of the record is 100 pages and requested until the end of September to file the record. The court reporter stated she has other records she is working on, but did not specify when those records were due or the nature of the cases for which she was preparing records.

Because this is an accelerated appeal of an order terminating appellant's parental rights, we are required to dispose of this appeal within 180 days of the date the notice of appeal is filed. TEX. R. JUD. ADMIN. 6.2. Given the time constraints governing the disposition of this appeal and the ten-day limit on extensions to file the record in accelerated appeals, we grant the court reporter's request in part. See TEX. R. APP. P. 35.3(c) (extension of time to file record in accelerated appeal must not exceed 10 days).

We order the court reporter, Patricia A. Gaddis, to file the reporter's record by September 7, 2017. Further requests for extensions of time will be disfavored.

Luz Elena D. Chapa, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 30th day of August, 2017.

Chief Deputy Clerk
