This Court's April 17, 2018 Order and Notice of Intent to Dismiss for Want of Jurisdiction had denied relators' pro se emergency motion for leave to file this emergency application/petition for writ of mandamus and affidavit to proceed as indigent. That Order had also directed relator Whitfield to file a permission order from the appropriate local administrative judge, within 10 days of that Order, to file this joint mandamus petition because he had been determined to be a vexatious litigant.
On April 20, 2018, relator Brandy Brenay Charles filed a response stating that she had requested in their joint motion for leave that her petition be filed separately. Accordingly, relator Charles is ordered to file a separate motion to treat the joint petition as two separate petitions within 10 days from the date of this Order, with the original petition to be treated as filed by relator Whitfield alone.
With their response, both relators also included a motion for a 30-day extension of time for relator Whitfield to seek a permission order from local administrative judge Robert Schaffer. Relator Whitfield's motion for a 30-day extension of time to file a permission order is granted. Accordingly, relator's Whitfield's permission order from the appropriate local administrative judge, if any, is due to be filed with the Clerk of this Court within 30 days from the date of this Order.
