This proceeding arises out of Cause No. DC-03-32, styled Enrique "Henry" Garza, Individually and On Behalf of the Estate of Emma Garza, Deceased, and Roberto "Bobby" Garza, pending in the 229th Judicial District Court, Duval County, Texas, the Honorable Alex Gabert presiding.

Petition for Writ of Mandamus Denied As Moot.

MEMORANDUM OPINION


The court has considered relator's petition for writ of mandamus seeking relief from the trial court's order denying a severance. After the relator filed its petition, the trial court reconsidered its decision and granted the severance. Accordingly, relator's petition for writ of mandamus is denied as moot. Relator shall pay all costs incurred in this proceeding.
