Opinion

No. 05-08-01276-CV

Opinion Filed March 30, 2009.

On Appeal from the 15th Judicial District Court, Grayson County, Texas, Trial Court Cause No. 07-0465-15.

Before Chief Justice THOMAS and Justices O'NEILL and MURPHY.

MEMORANDUM OPINION

Appellant filed a notice of appeal from the judgment terminating her parental rights. Appellant, who was found not to be entitled to proceed without payment of costs, did not pay for the reporter's record, and the appeal was submitted without the record. On March 18, 2009, we received correspondence from counsel stating that he has encouraged appellant to pay for the reporter's record, but she has not, and without the reporter's record, he would not be filing an appellant's brief. Because no appellant's brief will be filed, we dismiss the appeal for want of prosecution. See Tex. R. App. P. 38.8(a)(1).
