Appellant W.-C.X.H.'s brief initially was due on November 27, 2023. Appellant W.-C.X.H.'s appointed counsel requested and obtained two extensions of the briefing deadline, making Appellant W.-C.X.H.'s brief due on December 29, 2023. In its order extending the deadline to December 29, 2023, the Court stated that no further extensions would be granted.
Appellant W.-C.X.H.'s counsel did not file an appellant's brief on December 29, 2023, and instead moved for a third extension of time, requesting until January 5, 2024, to file the appellant's brief. The third motion for extension of time is GRANTED IN PART.
Appellant W.-C.X.H.'s brief is due on or before January 4, 2024. No further extensions will be granted.
If Appellant W.-C.X.H.'s brief is not filed on or before January 4, 2024, this Court may abate the appeal for the trial court to determine whether new counsel should be appointed for Appellant W.-C.X.H. because appointed counsel has abandoned the appeal and should be relieved of his duties. See Tex. Fam. Code § 107.016(2); In re M.V.G., 285 S.W.3d 573, 575-76 (Tex. App.- Waco 2009, order).
Because this is a termination appeal, this Court is required to dispose of this appeal within 180 days of the date the notice of appeal is filed, so far as reasonably possible. See Tex. St. Jud. Admin. R. 6.2(a). Here, the 180-day compliance deadline is set for April 12, 2024.
It is so ORDERED.
