On October 26, 2023, relator Diana Castano filed a petition for writ of mandamus arguing that the trial court abused its discretion by "failing to grant" relator's motion to transfer venue on causes of action asserted by real party in interest Wendy Hernandez in the underlying trial court cause number. Relator further asserted in her mandamus petition that the Court "should abate the proceedings in the trial court pending adjudication of this writ of mandamus."

On November 6, 2023, relator filed an "Emergency Motion to Abate Proceedings in Fort Bend." In her motion, relator requested that the Court abate the underlying trial court cause number pending the Court's consideration of her petition for writ of mandamus. Specifically, relator requested the abatement prior to the trial court's consideration of Hernandez's motion for summary judgment. According to relator's motion, the "trial court intends on hearing evidence and submission" of Hernandez's motion on November 7, 2023.

Relator's emergency motion for abatement of the trial court's proceedings is denied. See Tex. R. App. P. 52.10(a).

It is so ORDERED.
