IN RE R+L CARRIERS and Eric Cunningham

MEMORANDUM OPINION

Original Mandamus Proceeding PER CURIAM Sitting: Karen Angelini, Justice Patricia O. Alvarez, Justice Luz Elena D. Chapa, Justice PETITION FOR WRIT OF MANDAMUS DENIED

This proceeding arises out of Cause No. 2014-CI-05907, styled Richard Fissette v. R+L Carriers; Documation, LLC; and Eric Cunningham, pending in the 438th Judicial District Court, Bexar County, Texas, the Honorable Martha B. Tanner presiding. --------

On December 23, 2015, relators R+L Carriers and Eric Cunningham filed a petition for writ of mandamus and motion for temporary relief pending a ruling on the mandamus petition. The real party in interest has filed responses to both the motion and the mandamus petition. The court has considered the petition for writ of mandamus, and the real party in interest's response and relators' reply, and is of the opinion that relators are not entitled to the relief sought. Accordingly, the petition for writ of mandamus and motion for temporary relief are denied. See TEX. R. APP. P. 52.8(a).
