IN RE R+L CARRIERS and Eric Cunningham

Original Mandamus Proceeding

This proceeding arises out of Cause No. 2014-CI-05907, styled Richard Fissette v. R+L Carriers; Documation, LLC; and Eric Cunningham, pending in the 438th Judicial District Court, Bexar County, Texas, the Honorable Martha B. Tanner presiding. --------

ORDER

Sitting: Karen Angelini, Justice Patricia O. Alvarez, Justice Luz Elena D. Chapa, Justice

On December 23, 2015, relators filed a petition for writ of mandamus and motion for temporary relief pending a ruling on the mandamus petition. The court has considered the petition for writ of mandamus, as well as the responses and reply of the parties, and is of the opinion that relators are not entitled to the relief sought. Accordingly, the petition for writ of mandamus and motion for temporary relief are DENIED. See TEX. R. APP. P. 52.8(a). The court's opinion will issue at a later date.

The real party in interest's request for sanctions is DENIED.

It is so ORDERED on January 6, 2016.

Patricia O. Alvarez, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 6th day of January, 2016.
