THE COURT

On the court's own motion, the opinion filed and on February 25, 2008, is modified as follows:

On page 4, footnote 3, the sentence beginning with "A Harvey waiver permits . . ." is modified to read:

A Harvey waiver permits a sentencing court to consider counts that were dismissed under a plea bargain and that are not transactionally related to the admitted offense.

There is no change in the judgment.
