IN RE KELLY RAY CAPREZ AND RONALD CAPREZ, Relators
ORIGINAL PROCEEDING WRIT OF MANDAMUS 127th District Court Harris County, Texas Trial Court Cause No. 2024-16078
Panel consists of Justices Jewell, Bourliot, and Zimmerer.
ORDER
PER CURIAM
On October 16, 2024, relators Kelly Ray Caprez and Ronald Caprez filed a petition for writ of mandamus in this Court. See Tex. Gov't Code Ann. § 22.221; see also Tex.R.App.P. 52. In the petition, relator asks this Court to compel the Honorable Ravi K. Sandill, presiding judge of the 127th District Court of Harris County, to vacate the trial court's October 7, 2024 order granting plaintiff's motions to compel.
On October 17, 2024, this Court requested from the real party in interest a response to relators' petition for writ of mandamus due by October 31, 2024.
On October 18, 2024, relators filed a Motion for Emergency Relief. Relators seek a stay of the underlying trial proceedings, asserting that compliance with the trial court's order is due on October 22, 2024.
It appears from the facts stated in the petition and motion that relators' request for relief requires further consideration and that relators will be prejudiced unless immediate temporary relief is granted. We therefore GRANT relators' motion, in part, and issue the following order:
We ORDER the trial court's October 7, 2024 order granting plaintiff's motion to compel in Cause Number, 2024-16078, Mirian Hernandez vs. W.L. York, Inc. d/b/a The Cover Girls, Kelly Ray Caprez and Ronald Charles Caprez, STAYED until a final decision by this court on relators' petition for writ of mandamus, or until further order of this Court.
