MOTION DECISION

Present - Hon. Barbara R. Kapnick, Justice Presiding, Troy K. Webber, Cynthia S. Kern, Angela M. Mazzarelli, Saliann Scarpulla, Justices.

An order of this Court, having been entered on November 7, 2019 (M-3576), deeming the offense of which petitioner had been convicted a "serious crime" and immediately suspending petitioner (who was admitted to practice as an attorney and counselor-at-law in the State of New York at a Term of the Appellate Division of the Supreme Court for the First Judicial Department on February 3, 1992), from the practice of law effective the date thereof and until further order of the Court, and referring the matter to a referee for a hearing as to the appropriate sanction, And a per curiam pinion and order of this Court, having been entered on February 18, 2021 (M-2020-03510), confirming the referee's report and suspending petitioner from the practice of law for a period of two years, nunc pro tunc to November 7, 2019, and until further order of this Court, And petitioner having moved this Court on December 27, 2021, for an order pursuant to 22 NYCRR 1240.16 reinstating him as an attorney and counselor-at-law in the State of New York, And the Attorney Grievance Committee, by Jorge Dopico, its Chief Attorney (Raymond Vallejo, Esq., of counsel), having submitted an affirmation, dated December 16, 2021, stating, inter alia, that it does not oppose petitioner's reinstatement,

And the Lawyers' Fund for Client Protection having submitted a letter, dated November 9, 2021, stating that it has no objection to the relief sought, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, it is unanimously, Order ed that the motion is granted and petitioner Gordon R. Caplan is reinstated as an attorney and counselor-at-law in the State of New York, effective the date hereof. Petitioner shall timely renew his registration with the Office of Court Administration in compliance with Judiciary Law § 468-a, due in March 2022.
