ORDER RESOLVING OBJECTION TO CLAIM OF CGU(#131,#233)
This matter came before the Court on The Objection to Proof of Claims filed by the Debtors, Camellia Food Stores, Inc., Eastern Shore Markets, Inc., and Bonnie Be-Lo Markets, Inc. (collectively the "Debtors") asking this Court to disallow the proof of claim filed by OneBeacon Insurance f/k/a CGU Insurance and General Accident Insurance Company of America (the "Claimant"), which claim was original number 131 and amended by claim number 233. A copy of the Objection and Notice thereof was mailed to the Claimant, pursuant to Bankruptcy Rule 3007. The Claimant filed a response to the Objection and the hearing thereon was scheduled for July 11, 2002.
Based upon information provided the Debtors in the Response and upon the exchange of further information between counsel for the Debtors and Claimant, all issues regarding the Objection were resolved prior to the heading.
Upon consideration whereof, it is hereby ORDERED that the Debtors' Objection to Claim #131, as amended by #233, is sustained to the extent that the unsecured claim of Claimant exceeds $125,000.00;
It is further ORDERED that Claimant shall have an allowed unsecured claim against the Estate in the amount of $125,000.00.
