AN ORIGINAL PROCEEDING IN MANDAMUS ORDER
The Court has reviewed the mandamus petition filed by Relator, Theresa Caballero, and has determined that a response should be filed. While any party, including the respondent, may file a response to the petition, typically the real party in interest files the response. See TEX.R.APP.P. 52.4. The mandamus petition does not identify a real party in interest as required by TEX.R.APP.P. 52.3(a) because Relator is of the opinion that there is no real party in interest. The Court has determined that the State of Texas or El Paso County may have an interest directly affected by the relief sought by Relator. See TEX.R.APP.P. 52.2. The Court requests that the 34th District Attorney's Office and the El Paso County Attorney's Office notify the Clerk of the Court no later than April 25, 2015 whether the State of Texas or El Paso County is a real party in interest to this original proceeding and whether either intends to file a response to the mandamus petition. Any response to the petition from Respondent or any real party in interest is due to be filed no later than May 15, 2015.
