ORDER
Sima G. Patel, Judge, acting under MCR 7.217 and MCR 7.219(I), orders:
This cause is REMANDED to the Oakland County Probate Court for the appointment of substitute counsel, William L. Spern, current counsel, having repeatedly failed to timely file the brief on appeal.
William Spern, appointed counsel for appellant, shall pay to the Clerk of this Court, within 21 days of the certification of this order, court costs in the sum of $250 for allowing this appeal to appear on the involuntary dismissal docket. Such costs are personal to the attorney and shall not be charged back to the County or to the State.
The Clerk's Office is directed to e-mail a copy of this order to Judge Kathleen A. Ryan at ryanka@oakgov.com so that Judge Ryan may appoint substitute counsel on behalf of respondent as soon as possible. The Court requests that Judge Ryan forward a copy of the order appointing substitute counsel to the Court of Appeals at 201 W. Big Beaver Road, Suite 800, Troy, Michigan 48084.
