ORIGINAL PROCEEDING WRIT OF MANDAMUS 11th District Court Harris County, Texas Trial Court Cause No. 2022-55528
Panel Consists of Chief Justice Christopher, Justices Zimmerer and Wilson.
ORDER
PER CURIAM
On Tuesday, March 26, 2024, relators C-Automation, Inc., C-Automation OPS, LLC, and Michael Gould filed a petition for writ of mandamus in this court. Relators ask this court to order the Honorable Kristen Brauchle Hawkins, Judge of the 11th District Court, in Harris County, Texas, to set aside her order dated March 6, 2024, entered in trial court number 2022-55528, to compel discovery on requests for production numbers 63, 64, and 66. Relators claim respondent abused her discretion by granting the motions to compel discovery on requests for production numbers 63, 64, and 66.
Relators have also filed a motion for temporary stay of the order to compel discovery on requests for product numbers 63, 64, and 66. See Tex. R. App. P. 52.8(b), 52.10. On March 26, 2024, relators asked this court to stay (1) the order to compel discovery on requests for product numbers 63, 64, and 66 and (2) enforcement proceedings related to that order, including a hearing on a motion for sanctions filed by the real parties in interest pending a decision on the petition for writ of mandamus.
It appears from the facts stated in the petition and motion that relators' request for relief requires further consideration and that relators will be prejudiced unless immediate temporary relief is granted. We therefore GRANT relators' motion and issue the following order:
We ORDER (1) the March 6, 2024 order to compel discovery on requests for product numbers 63, 64, and, 66 in trial court cause number 2022-55528, and (2) enforcement proceedings related to that order, including a hearing on a motion for sanctions filed by the real parties in interest STAYED until a final decision by this court on relators' petition for writ of mandamus, or until further order of this court.
In addition, the court requests Tiago Salies, Annie Mauldin, Bryan Kelley, and Apex Manufactured Solutions, LLC, the real parties in interest, to file a response to the petition for writ of mandamus on or before April 17, 2024. See Tex. R. App. P. 52.4.
