The application of William Vogel and Aubrey Grant for leave to intervene or in the alternative to file an amicus curiae brief in support of petitioner Roy Butler is denied in part and granted in part.

The application for leave to intervene is denied.

The application for leave to file an amicus curiae brief is granted. In granting permission to file the amicus curiae brief, the court does not expand the issues on review beyond those specified in its order of November 16, 2016, or request the parties to brief any issues other than those previously specified.

Any party may file an answer subject to the restrictions set forth in California Rule of Court 8.520(f)(7).
