Opinion

C.A. No. 01-1409 (DRD).

March, 2001

James W. Bryson, Petitioner, pro se ipso.

OPINION

James W. Bryson ("Bryson") has petitioned this court to issue a writ of mandamus compelling the New Jersey Superior Court, Bergen County, "to lawfully exercise its prescribed jurisdiction, in terms of being compelled to exercise its authority to perform their plenary duty, with regards to the review, interpretation, and application of legal precepts in terms of fairness and equality of law; in the interest of Justice." Petition for a Writ of Mandamus of James W. Bryson, filed 3/23/01, at 2. Just what Bryson would have this court compel the New Jersey Superior Court to do is unclear from his petition; but, in any event, this court lacks the judicial power to issue a writ of mandamus to a state court. In re Richards, 213 F.3d 773, 781-82 (3rd Cir. 2000); In re Grand Jury Proceedings, 654 F.2d 268, 278 n. 19 (3rd Cir. 1981). This court lacks jurisdiction over the subject matter of Bryson's petition; accordingly, both the petition and the above-captioned civil action must be dismissed.

An appropriate order shall enter.
