REPONDENT JUDGE MARISSA J. BRUMBACH'S PETITION FOR EXTENSION OF TIME TO FILE AN OMNIBUS MOTION
Respondent Judge Marissa J. Brumbach, by and through the undersigned counsel, requests an extension of time to file her omnibus motion and avers as follows:
1. On December 14, 2022, the Judicial Conduct Board filed a Complaint against Judge Brumbach alleging nine counts of judicial misconduct.
2. On January 6, 2023, this Court held a hearing on the Board's Petition For Relief For Interim Suspension Without Pay.
3. Pursuant to the Court of Judicial Discipline Rule of Procedure 411, Judge Brumbach's omnibus motion is due January 13, 2023.
4. As of the filing of this Petition, this Court has not issued an Order regarding the January 6, 2023 hearing.
5. As of the filing of this Petition, Judge Brumbach has not received a transcript from the January 6, 2023 hearing.
6. Judge Brumbach respectfully requests a short two-week extension of time to file her omnibus motion on or by January 27, 2023.
7. This short extension is necessary because undersigned counsel had been focused primarily on preparing for the January 6, 2023 hearing.
8. Moreover, a short extension will allow Judge Brumbach sufficient time to review the transcript from the January 6, 2023 hearing before filing her motion.
9. Counsel for Judge Brumbach has conferred with the Board's counsel and the Board does not object to Judge Brumbach's request.
WHEREFORE, it is respectfully requested that this Honorable Court grant Judge Brumbach's Petition for Extension of Time to File an Omnibus Motion.
