Opinion

No. 05-05-01374-CV

Opinion issued October 17, 2005.

Original Proceeding from the 303rd Judicial District Court, Dallas County, Texas, Trial Court Cause No. 90-6111-V.

Writ of Mandamus Denied.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator Basil Brown contends the trial judge erred in scheduling a hearing on real party's motion for contempt before the judge conducted a hearing on relator's appeal from the associate judge's report. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus.
