Opinion

No. 05-04-00171-CV.

Opinion Issued March 17, 2004.

Original Proceeding from the 134th, Judicial District Court, Dallas County, Texas, Trial Court Cause No. 03-03723.

Writ of Mandamus Denied.

Before Justices MORRIS, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

Relator contends the trial judge erred in entering an order staying arbitration and denying relator's motion to compel arbitration. We DENY real party in interest's motion to supplement the record as unnecessary as the filing of the supplemental record with the Court makes it a part of the record for this original proceeding. Based on the record presented, we conclude the relator has failed to show the trial court clearly abused its discretion in granting the motion to stay arbitration and denying the motion to compel arbitration. Accordingly, relator's petition for writ of mandamus is DENIED. See 52.8(a).
