MEMORANDUM OPINION


In this original mandamus proceeding, relator asks us to order the trial judge to set aside the trial court's order dismissing relator's case against real party. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.8(a); In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004). Accordingly, we DENY relator's petition for writ of mandamus.
