This proceeding arises out of Cause Nos. 2001-CVQ-000422-D2; 2002-CVQ-01206-D2 2004-CVQ-000520-D2, respectively styled Lewis Petro Properties, Inc. v. William T. Booth; Cerrito Gathering Co, Ltd. and Lewis Petro Properties, Inc. v. William T. Booth, Kay Booth, and John Vernon Booth; and W.V. Booth Family Partnership and Middleton Limited Partnership v. Lewis Petro Properties, Inc., et al., pending in the 111th Judicial District Court, Webb County, Texas, the Honorable Raul Vasquez presiding.

Petition for Writ of Mandamus Denied.

MEMORANDUM OPINION


The court has considered relator's petition for writ of mandamus and motion for emergency stay. The court is of the opinion that relief should be denied. See Tex.R.App.P. 52.8(a). Accordingly, relator's petition for writ of mandamus and motion for emergency stay are denied. Relator shall pay all costs incurred in this proceeding.
