BIVERT (KENNETH RAY) ON H.C.

Order filed

Petitioner's “Amended Motion to Seal Records In Exhibits 1 and 9 to the Amended Petition for Writ of Habeas Corpus,” filed on March 7, 2017, is granted in part and denied in part, as follows.

The application to file under seal pages 112-188 of Exhibit 1 is granted. (Cal. Rules of Court, rule 8.47(c)(1).) The application to file under seal pages 189-273 of Exhibit 1 is denied. Because these pages are bound together in one volume, which was lodged conditionally under seal on March 7, 2017, the Clerk is directed to return this exhibit to petitioner. Within 10 days from the date of this order, petitioner must serve and file pages 112-188 as Exhibit 1A for filing under seal and pages 189-273 as Exhibit 1B for public filing. Upon receiving the exhibits, the Clerk will file Exhibit 1A under seal and publicly file Exhibit 1B.

The application to file under seal Exhibit 9 is denied without prejudice as follows. Within 21 days from the date of this order, petitioner must serve and lodge with this court a public version of Exhibit 9 that redacts the inmates' names, California Department of Corrections and Rehabilitation numbers, birth dates, and other identifying information, along with a renewed application to file under seal the unredacted version of Exhibit 9, lodged conditionally under seal on March 7, 2017. (See Cal. Rules of Court, rule 2.550(e)(1)(B).) Petitioner's own identifying information on pages 4301-4303 in Exhibit 9 must not be redacted.
