MOTION DECISION

DECISION & ORDER ON MOTION

Motion by Irene Greenberg, the court-appointed inventory attorney with respect to the above-entitled matter, to be discharged as inventory attorney for the files of Ira E. Berliner. Mr. Berliner was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on January 15, 1973. Mr. Berliner died on November 24, 2015.

By decision and order on application of this Court dated April 22, 2016, Gary L. Casella, former Chief Counsel, Grievance Committee for the Ninth Judicial District, was appointed as inventory attorney. By decision and order on application dated August 17, 2016, Mr. Casella was relieved as inventory attorney and Carl David Birman was appointed as inventory attorney. By decision and order on application dated November 3, 2016, Mr. Birman was relieved as inventory attorney and Irene Greenberg was appointed as inventory attorney.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further, ORDERED that Irene Greenberg is authorized to arrange for the destruction of any unclaimed files of Ira E. Berliner, under the guidance of Muriel L. Gennosa, Executive Director for Attorney Matters; and it is further, ORDERED that Irene Greenberg is directed to deliver any unclaimed original wills located in the files of Ira E. Berliner, as well as all banking and bookkeeping records related to Mr. Berliner's former law practice, to the Grievance Committee for the Ninth Judicial District; and it is further, ORDERED that Irene Greenberg shall provide the Grievance Committee for the Ninth Judicial District with a list of all files of Ira E. Berliner inventoried; and it is further, ORDERED that upon the completion of the foregoing, Irene Greenberg is discharged as inventory attorney in the above-entitled matter.
