IN THE MATTER of the Guardianship of Carlos BENAVIDES Jr. An Incapacitated Person
From the County Court at Law No 2, Webb County, Texas
Trial Court No. 2011PB000081L2
The Honorable Martha B. Tanner, Judge Presiding
ORDER
Appellant's brief was originally due June 20, 2013; however, the court granted appellant an extension of time to file the brief until August 19, 2013 — sixty days after it was originally due. Our order advised appellant that no further extensions of time would be granted absent a showing of extraordinary circumstances that prevented the timely filing of a brief. On August 13, 2013, appellant filed a motion requesting thirty more days to file her brief. Appellant states a further extension is necessary because of the large size of the record, counsel's difficulty accessing the electronically filed exhibits, and because of counsel's other related and unrelated work.
Due to the size of the record and difficulties relating to the exhibits, we find counsel has shown circumstances justifying a further extension. We therefore grant the motion and order appellant's brief due September 18, 2013. No further extensions of time will be granted. If appellant's brief is not filed by the date ordered, the appeal may be dismissed without further notice. See TEX. R. APP. P. 38.8(a); 42.3(c).
