IN RE SAMANTHA HALE BATTENFIELD

Original Mandamus Proceeding

Before Stevens, C.J., van Cleef and Rambin, JJ.

ORDER

Relator Samantha Hale Battenfield recently filed a petition for a writ of mandamus from the trial court's order of October 2, 2024, dismissing her petition in intervention. Pending before this Court is Relator's unopposed motion to stay, which asks this Court to stay any proceedings in the underlying matter in the 115th Judicial District Court of Marion County pending the resolution of the mandamus petition.

Because this Court needs sufficient time to review the merits of Relator's petition, we issue a temporary stay, effective immediately. See Tex. R. App. P. 52.10(b) (permitting granting of "any just relief pending the court's action on the petition"). The temporary stay is "effective until the case is finally decided," unless vacated or modified by further order of this Court. Id.

IT IS SO ORDERED.
