STIPULATION AND CONSENT ORDER RESOLVING OBJECTIONS TO DISPUTED CLAIMS
Upon consideration of the Motion of the Trustee to Approve Order Resolving and Objections to Disputed Claims, (the "Motion") and upon the consent of the undersigned Trustee, Marc H. Baer, Chapter 7 Trustee of Bateson Construction, Inc. ("Trustee"), Clark Realty Builders, LLC ("Clark"), and Bozzuto Construction Co. ("Bozzuto") and as reflected by their signatures or the signatures of their respective counsel to the entry of an Order in the following format, after notice and good cause having been shown, without opposition, it is by the United States Bankrupt Court for the District of Maryland;
ORDERED, That the Trustee's Motion is GRANTED, and it is further
ORDERED, the Stipulation and Consent Order Resolving Objections to Disputed Claims is APPROVED and it is further;
ORDERED, the Proof of Claim of Bozzuto Construction Co. (Claim No. 3) shall be reduced from $2,611,302.51 to $2,115,155.03, and Bozzuto shall be allowed as a non-priority, general unsecured claim in the amount of $2,115,155.03 and it is further; ORDERED, the Proof of Claim of Clark Realty Builders, LLC (Claim No 15) shall be reduced from $5,891,995.19 to $4,772,516.10, and Clark shall be allowed a non-priority, general unsecured claim in the amount of $4,772,516.10, and it is further
ORDERED, the Objections of the Trustee to Claim Nos. 3 and 15, as modified herein, shall be and hereby are withdrawn.
