IN RE JOEL CHRISTOPHER BARTON, Relator

Original Proceeding from the 219th Judicial District Court Collin County, Texas
Trial Court Cause No. 219-50662-07

ORDER

On June 14, 2017, relator Joel Christopher Barton filed a letter notifying the Court that the parties had reached a settlement and asked the Court to "hold on ruling" in this original proceeding. Relator stated that he "will officially withdraw his Petition upon entry of the final agreed order." On July 13, 2017, we ordered relator to file a status report or the necessary motion to dismiss with the Court on or before August 14, 2017. Relator filed a status report as requested and notified the Court that "the parties have not yet reached an agreement on the language for a final order incorporating the terms of their agreement that will resolve the issues in this case." Relator asks the Court to continue to hold this proceeding in abatement pending entry of a final order in the trial court.

We grant relator's request to the extent that the Court will not take any action in this proceeding until after August 30, 2017. If relator does not file a motion to dismiss by August 30, 2017, this Court will proceed to determine the merits of relator's petition for writ of mandamus.
