The motion to extend time to file appellant's brief is DENIED; the time for filing appellant's brief on appeal shall start to run when an accurate notice of filing all transcripts in the trial court is filed with this Court. MCR 7.210(B)(3)(e); MCR 7.212(A)(1)(a)(i).
On the Court's own motion, the August 9, 2021 notice of filing transcripts filed by Court Reporter Margot A. Games (CER 9561) is STRICKEN for containing an inaccurate statement regarding the filing of transcripts with the trial court. Further, on or before October 5, 2021, Margot A. Games (CER 9561) shall file all transcripts for this appeal with the trial court as required by MCR 7.210(B)(3)(d), email a copy of all transcripts to all counsel, and provide this Court with an accurate notice of filing transcripts in the trial court. Further, pursuant to MCR 7.210(B)(3)(f), this Court orders that court reporter Margot A. Games (CER 9561) is ASSESSED COSTS of $250 as a sanction for her failure to timely file the transcripts for this priority appeal. The $250 in costs shall be paid to the Clerk of the Court within 21 days of the Clerk's certification of this order.
If Margot A. Games (CER 9561) does not comply with the October 5, 2021 deadline set forth in this order, she shall personally appear in the Court of Appeals courtroom located at 350 Ottawa N.W. in Grand Rapids, Michigan on October 8, 2021 at 10:00 a.m. to explain why the complete transcripts have not been filed, and to further explain why she is not in contempt of this Court for failing to comply with this Court's orders.
A copy of this order shall be furnished to First Judicial Circuit Court Chief Judge Sara S. Lisznyai, and Denice Purves at the State Court Administrative Office.
