ORDER

1Considering the Motion for Reinstatement to the Practice of Law filed by respondent, David Band, Jr.,

IT IS ORDERED that respondent shall be conditionally reinstated to the practice of law, subject to a one-year period of probation with the following requirements:

(1) As soon as practicable following the rendition of this order, upon respondent’s recommendation and the ODC’s approval, the ODC shall appoint a practice monitor to supervise respondent’s professional activities during the probationary period. Respondent shall comply with all reasonable requests of his practice monitor.

See generally Succession of Wallace, 574 So. 2d 348, 350 (La. 1991) (explaining that the Louisiana Supreme Court has exclusive and plenary power to define and regulate all facets of the practice of law, including the admission of attorneys to the bar, the professional responsibility and conduct of lawyers, the discipline, suspension and disbarment of lawyers, and the client-attorney relationship").

(2) Petitioner shall cooperate with the ODC, and shall comply with any and all requirements imposed upon him by the ODC, including, but not limited to, additional evaluation by the Judges and Lawyers Assistance Program.

(3) Upon the expiration of the current conditional reinstatement period, the ODC shall file a report in this court in which it shall recommend whether the conditional reinstatement shall be allowed to terminate or shall be extended.

Should respondent fail to comply with these conditions, or should he commit any misconduct during the period of probation, his conditional reinstatement to 2practice may be terminated immediately, or he may be subjected to other discipline pursuant to the Rules for Lawyer Disciplinary Enforcement, as appropriate.
