STIPULATION AND ORDER


The parties, by and through their undersigned counsel, stipulate to the following:

WHEREAS, Defendants filed the Motion for Summary Judgment [Doc. No. 39] (the "Motion") on November 29, 2007;

WHEREAS, Plaintiff's initial deadline for responding to the Motion was December 17, 2007;

WHEREAS, on December 6, 2007, the Court entered a stipulation and order providing that, while the parties were engaged in settlement discussions, Plaintiff's deadline for responding to the Motion would be extended until 14 days after either party informed the other that it wished to proceed with the Motion, or until otherwise ordered by the Court;

WHEREAS, Defendants informed Plaintiff that they wished to proceed with the Motion on February 14, 2008;

WHEREAS, the parties have continued settlement discussions and have reached an agreement in principle;

NOW, THEREFORE, the parties stipulate that Plaintiff's deadline for responding to the Motion shall be extended until 14 days after either party informs the other that it wishes to proceed with the Motion, or until otherwise ordered by the Court.

SO ORDERED.
