IN RE BAJA FREIGHT, LTD AND OMAR OLVERA

From the 341st Judicial District Court, Webb County, Texas Trial Court No. 2023CVK001858D3 Honorable Rebecca Ramirez Palomo, Judge Presiding

Sitting: Irene Rios, Justice Beth Watkins, Justice Liza A. Rodriguez, Justice

ORDER

PER CURIAM.

On November 17, 2023, relators filed a petition for writ of mandamus seeking to reverse the trial court's November 16, 2023 "Order on Petitioners' Verified Petition to Take Depositions Pursuant to TRCP 202 and to Maintain Status Quo." In that order, the trial court denied relators' request to stay one or more surgeries real parties in interest had scheduled for November 17, 2023. Relators also filed a motion for emergency relief arguing that they are entitled, under Texas Rule of Civil Procedure 202, to conduct depositions of the real parties in interest regarding the real parties' pre-surgery condition. Relators contend that real parties in interest are scheduled to undergo surgery on November 17, 2023. We ORDER relators, Baja Freight Ltd. and Omar Olvera, and real parties in interest, Juan Guzman and Heriberto Navarro to, no later than 10:00 am on Monday, November 20, 2023, file a written response indicating whether Juan Guzman and Heriberto Navarro have undergone the surgeries at issue in relators' petition and motion.

It is so ORDERED.
