ORDER

The court has before it a motion by United States Department of Agriculture/Rural Development for the dismissal of the petition in this case.

Upon due consideration of the motion, the court finds that the Debtors have failed to commence making timely payments as required by the Chapter 13 plan that they has filed and 11 U.S.C Section 1326.

THEREFORE, the motion to dismiss is granted and the petition in this case is dismissed.
