STIPULATION AND CONSENT ORDER GRANTING MOTION TO VACATE ORDER
DISMISSING CHAPTER 7 CASE
PURSUANT TO FED. R. CIV. P. 59(e) and FED. R. BANKR. P. 9023
WHEREAS, AUGSBURG ACADEMY (the "Debtor"), having filed a Motion to Vacate Order Dismissing Chapter 7 Case Pursuant to Fed. R. Civ. P. 59(e) and Fed. R. Bankr. P. 9023 (the "Motion to Vacate"), and GARY ROSEN (the "Trustee"), the latter desiring to conclude the Section 341 meeting to determine the existence of any assets or related matters, HEREBY stipulate and consent that:
1. The Motion to Vacate shall be GRANTED.
2. The Section 341 meeting shall be reset by the Trustee on a consented to date with the Debtor, and if the Debtor fails to appear, the above captioned case may be dismissed.
