Summary of Misconduct:

Mr. Ashbell, who was licensed in 1979, was suspended for 30 days. During the course of representing a plaintiff in a medical malpractice action, Mr. Ashbell, who is also a physician, met separately with two of his client's former physicians, representing to them that he was meeting with them as a fellow doctor. The physicians were unrepresented by counsel and revealed confidential information that Mr. Ashbell later attempted to use to further his client's case.


Order of the Court:

The petition by the Administrator of the Attorney Registration and Disciplinary Commission to impose discipline on consent pursuant to Supreme Court Rule 762(b) is allowed, and respondent Theodore S. Ashbell is suspended from the practice of law for 30 days. Suspension effective October 18, 2004. Respondent Theodore S. Ashbell shall reimburse the Disciplinary Fund for any Client Protection payments arising from his conduct prior to the termination of the period of suspension.
