Laws 2006, Ch. 308 amended A.R.S. § 38-893 to authorize establishment of a local board responsible to administer and make effective the Correctional Officer Retirement Plan (CORP) for probation officers, surveillance officers and juvenile detention officers employed by the Superior Court of Arizona. The statute provides that this Board shall be comprised of five members, three members appointed by the Chief Justice and two elected members.

In compliance with this statutory requirement on February 8, 2007, the following individuals were appointed as members to this Board. However, as stipulated by statute, the remaining vacancies would need to be filled by an election. The election of these two remaining members was completed in November 2007 with effective term of office dates beginning July 1, 2007. Because there are different beginning dates for the terms of office for both the appointed and elected members, the statutory requirement for bi-annual appointments and elections cannot fulfilled. Therefore, to comply with statutes and appointment cycles of our standing committees and commissions, it is necessary to amend the dates of the terms of office for the appointed members. The CORP Local Board requests approval to amend Administrative Order No. 2007-16 to establish the beginning dates for the terms of office for the appointed members as July 1, 2007.

Now, therefore, pursuant to A.R.S. § 38-893 and the administrative supervisory authority provided by Az. Const. Art 6, § 3,

IT IS ORDERED that Kevin Kluge is designated to serve as a member of the Correctional Officer Retirement Plan Local Board for the Superior Court for a two-year term.

IT IS FURTHER ORDERED that Phillip Hanley, the head of the human resources department of the Superior Court in Maricopa County, is appointed to serve on the Correctional Officer Retirement Plan Local Board for the Superior Court for a four-year term.

IT IS FURTHER ORDERED that Jim Bruner is appointed to serve as Chair of the Correctional Officer Retirement Plan Local Board for the Superior Court for a four-year term.

IT IS FURTHER ORDERED, nunc pro tunc, that all terms shall begin on July 1, 2007.
