IN THE INTEREST OF A.O., A CHILD

From the 285th Judicial District Court, Bexar County, Texas
Trial Court No. 2017PA01432
Honorable Richard Garcia, Judge Presiding

ORDER

This is an accelerated appeal of an order terminating the appellant's parental rights which must be disposed of by this court within 180 days of the date the notice of appeal is filed. TEX. R. JUD. ADMIN. 6.2.

On May 16, 2018, the trial court clerk filed a notification of late record stating that the clerk's record was not filed because appellant failed to pay or make arrangements to pay the clerk's fee for preparing the record and appellant is not entitled to appeal without paying the fee. By order dated May 18, 2018, appellant was ordered to written proof to this court that either (1) the clerk's fee had been paid; or (2) appellant is entitled to appeal without paying the clerk's fee. Appellant did not respond to this court's order; however, the notice of appeal filed by appellant states appellant is presumed indigent, and our records reflect that appellant has appointed counsel representing her. It is therefore ORDERED that the trial court clerk check the records on file in the underlying cause to confirm appellant is not entitled to appeal without paying the fee for preparing the record. It is FURTHER ORDERED that the trial court clerk file either the clerk's record or written confirmation that appellant is not entitled to appeal without paying the fee for the preparation of the record no later than seven days from the date of this order.

The reporter's record, which was due to be filed on May 14, 2018, has not been filed. It is therefore ORDERED that the reporter's record must be filed in this appeal no later than ten days from the date of this order. TEX. R. APP. P. 35.3(c). FURTHER REQUESTS FOR EXTENSIONS OF TIME ARE DISFAVORED.

Sandee Bryan Marion, Chief Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 31st day of May, 2018.
