ORDER SUSTAINING TRUSTEE'S OBJECTION TO THE DEBTOR'S CLAIM OF EXEMPT PROPERTY
THIS MATTER came before the Court on January 30, 2006, for a hearing on the Trustee's Objection to the Debtor's Claim of Exempt Property. The Court having reviewed the Trustee's Objection and the case file; considered the argument and representations of counsel, and the Court being otherwise fully advised in the premises, it is
ORDERED that the Trustee's Objection to the Debtor's Claim of Exempt Property is sustained. The Debtor is allowed to claim as exempt, One Hundred Twenty Five Thousand and 00/100 ($125,000.00) Dollars of the equity in the Condominium Real Property located at 6372 La Costa Drive, Apartment 105, Boca Raton, Florida 33433, as her Homestead. To the extent the equity in the condominium exceeds the Debtor's allowed One Hundred Twenty Five Thousand and 00/100 ($125,000.00) Dollar exemption amount, the property is subject to administration by the Bankruptcy Trustee for the benefit of creditors. The Court makes no determination as to the value of the real property or the equity therein at this time. The Court will schedule an Evidentiary Hearing to determine the amount of the equity in the real property and the further administration of this case by separate Order.
