FINAL JUDGMENT
Pursuant to Federal Rule of Civil Procedure 58, judgment is hereby entered in favor of plaintiff Robert Watts and against defendants Warrior Gulf Navigation Company and Willie Odom as to plaintiff's claims for past medical expenses and past and future mental injuries. Judgment is hereby entered in favor of defendants Warrior Gulf Navigation Company and Mr. Odom and against plaintiff Robert Watts as to plaintiff's claim for past physical injuries.
In accordance with the jury verdict returned on June 28, 2000, plaintiff Robert Watts shall recover from defendant Warrior Gulf Navigation Company and Willie Odom the sum of Two Hundred Fifty-Three Thousand, Seventy-Seven and 75/100 Dollars ($253,077.75) LESS plaintiff's mandatory contributions to the Plaintiffs' Steering Committee (PSC) Fee Fund and the PSC Expense Fund — resulting in a net judgment of Two Hundred Forty Thousand, Four Hundred Twenty-Three and 86/100 ($243,423.86). Costs are taxed against defendants Warrior Gulf Navigation and Mr. Odom. Post-judgment interest shall accrue in accordance with 28 U.S.C. § 1961.
In accordance with Order No. 2 (as amended or supplemented by Order Nos. 48, 56, 64, 79, 81 169), plaintiff's mandatory contribution to the Fee Fund is $10,123.11 (4% of the gross verdict, and his contribution to the Expense Fund is $2,530.78 (1% of the gross verdict or $1,000 — whichever is greater).
Plaintiff's claims against defendant CSX Transportation, Inc. remain unresolved. In conformance with Federal Rule of Civil Procedure 54(b), the court make the express determination that there is no just reason for a delay in the entry of final judgment as to plaintiff's claims against defendant Warrior Gulf Navigation Company and Willie Odom. Additionally, the court expressly directs the entry of this final judgment.
